Terms of Service

1. Who we are

ViralShark (“ViralShark”, “we”, “us”) operates the service at viralshark.app. By creating an account or using the service you agree to these terms. If you do not agree, do not use the service.

2. What the service does

ViralShark collects publicly available short form posts from TikTok and Instagram into a shared library, and gives you an AI assistant that searches that library and reports what it finds. It is a research and ideas tool. It does not post on your behalf, and it does not manage your social accounts.

3. Your account

You need an account to use the service. Accounts are created through Clerk using Google or Apple sign in. You are responsible for activity under your account and for keeping access to your sign in provider secure.

You must be at least 18 years old, or the age of majority where you live, whichever is higher. One person or one business per account. Sharing a single account across a team is not permitted; buy a seat per person.

4. Subscription, trial and billing

The service is paid. There is no free tier. Current pricing is shown on the site and is charged in US dollars.

  • New accounts get a 3 day free trial. You will not be charged during the trial.
  • Unless you cancel before the trial ends, the subscription starts automatically and the card on file is charged.
  • Subscriptions renew monthly until you cancel.
  • You can cancel at any time from your billing settings. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then.
  • Payments are processed by Stripe. We never see or store your full card number.
  • Prices can change. We will give you notice before a change applies to your next renewal.

5. Refunds

Because the trial exists so that you can evaluate the service before paying, we do not offer refunds for periods you have already used. If you were charged in error, or something on our side stopped the service from working for a meaningful part of a billing period, email us and we will make it right.

6. Fair use

Reading the library is unmetered. Fetching new posts costs us money per request, so we apply internal limits to stop one account from consuming a shared resource in a way that degrades it for everyone. These limits are set well above normal use. We will contact you before restricting an account for volume.

7. Acceptable use

You agree not to:

  • Resell, redistribute or expose the library or the assistant to people outside your account.
  • Scrape, mirror or bulk export the service, or use automated means to access it outside the interface we provide.
  • Reverse engineer the service or attempt to extract our prompts, models or ranking logic.
  • Use the service to harass, impersonate or defame anyone, including the creators whose public posts appear in the library.
  • Use the service in a way that breaks the terms of TikTok, Instagram or any other platform you operate on.
  • Break the law, or use the service to help someone else break it.

8. Public content and third party platforms

The library contains publicly available posts, captions, hashtags, sounds and account handles collected from TikTok and Instagram. We do not own that content and we do not licence it to you. It is shown for research and reference. Copyright in each post stays with whoever made it.

We are not affiliated with, endorsed by, or partnered with TikTok, Instagram or Meta. If you are a creator and want a post removed from the library, email us and we will remove it.

9. Your content and our content

Anything you type into the service stays yours. You grant us the limited right to process it in order to run the service, which includes sending it to the AI providers we use to produce a response.

The service itself, including the interface, the prompts and the way results are ranked and presented, stays ours. Output the assistant produces for you is yours to use, including commercially.

10. What the assistant produces

The assistant is a language model reading a library of posts. It can be wrong. It can misread a video, miss context, or describe a pattern that is not there. Treat what it says as a starting point and check anything you are about to act on. We make no promise that following its suggestions will grow an account, produce views, or make money.

11. Availability

We aim to keep the service running but we do not guarantee uptime. Features can change or be removed. If we make a change that materially reduces what you are paying for, you can cancel and we will refund the unused part of that period.

12. Termination

You can stop using the service and cancel at any time. We can suspend or close an account that breaks these terms, that charges back a legitimate payment, or that puts the service or other users at risk. Where the breach is not serious we will warn you first.

13. Disclaimer

The service is provided as is and as available, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non infringement.

14. Limitation of liability

To the fullest extent the law allows, ViralShark is not liable for indirect, incidental or consequential damages, lost profits, lost revenue, or lost opportunity. Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim arose.

15. Changes to these terms

We can update these terms. If a change is material we will tell you by email or in the product before it takes effect. Continuing to use the service after that means you accept the new terms.
